Terms of Use

These Terms of Use ("Terms") govern use of the Vinica application, provided by Atendmax Tecnologia Ltda, Brazilian company registration number (CNPJ) 60.304.087/0001-12, headquartered at Rua Deputado Heitor Alencar Furtado, 3350, Suite 907, Mossunguê, Curitiba, Paraná, Brazil. By creating an account or using Vinica, you agree to these Terms and our Privacy Policy.

1. Acceptance

By registering for and using Vinica, you declare that you are at least 18 years old and have the legal capacity to enter into this agreement. If you use Vinica on behalf of a company, you declare that you are authorized to represent it.

2. What Vinica is

Vinica is a financial organization platform for individuals (CPF) and businesses (CNPJ). Through an AI assistant on WhatsApp and a web dashboard, it records transactions, separates personal and business finances, organizes cards, accounts, and appointments, and generates reports. Vinica is a management support tool and does not provide accounting, financial, legal, or investment advice.

3. Registration and account

Access uses a code sent to your email, without a password. You are responsible for keeping access to your email inbox and WhatsApp confidential and for all activity on your account. Registration information must be accurate and up to date.

4. Plans, subscriptions, and payments

• Vinica offers a 7-day free trial with no card required.
• After the trial, access requires a Professional plan subscription at R$ 89.90 per month, or R$ 59.90 per month on the annual plan (12 installments totaling R$ 718.80 per year). The applicable prices are always those displayed when you subscribe.
• Billing is recurring and handled by our payment provider. Failure to pay may result in suspension of access to features.
• You may cancel at any time without a penalty. Cancellation stops the next renewal; access continues until the end of the period already paid for.

5. Acceptable use

When using Vinica, you agree not to:

• use the service for unlawful or fraudulent purposes or to infringe third-party rights;
• attempt to access areas, accounts, or data that do not belong to you;
• compromise the platform's security, integrity, or availability;
• reverse engineer, copy, or resell the service without authorization.

6. Your data and content

The financial data and content you record remain yours. You grant us a limited license to process that content solely to provide the service, as described in the Privacy Policy. You are responsible for the accuracy and legality of the data you enter.

7. Artificial intelligence

The assistant uses AI models that may occasionally make classification or interpretation errors. Generated information and suggestions are informational and do not replace advice from a qualified professional, such as an accountant, lawyer, or adviser. Check important transactions and decisions.

8. Third-party integrations

Vinica integrates third-party services, such as Google Calendar and the WhatsApp Business Platform (Meta). Use of these integrations is also subject to their providers' terms and policies. We are not responsible for outages or changes to these external services.

9. Intellectual property

The Vinica brand, software, interface, and content belong to Atendmax Tecnologia Ltda or its licensors. These Terms do not transfer any intellectual property rights in the platform to you.

10. Availability and support

We strive to keep the service available, but maintenance or interruptions may occur. Support is available at hello@vinica.tech.

11. Limitation of liability

To the fullest extent permitted by law, Vinica is provided "as is." We are not responsible for indirect losses, lost profits, or decisions based on information generated by the platform. Nothing in these Terms excludes liability that cannot legally be limited.

12. Termination

You may close your account at any time. We may suspend or terminate access for a breach of these Terms, fraudulent use, or a legal requirement. For deletion of your data after account closure, see the Data Deletion page.

13. Changes to the Terms

We may update these Terms periodically. The last updated date appears at the top of this page. Continued use after changes constitutes acceptance of the current version.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Curitiba, State of Paraná, have jurisdiction over disputes, except where the law provides a different jurisdiction in favor of the consumer.
